These Terms of Use (“Terms”) govern your access to and use of the Cafe Bartique mobile application (“App”) and all related services provided by Cafe Bartique (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About the App
Cafe Bartique is a coffee shop and cafe located at 2315 Cascade Road, Atlanta, GA 30311. The App allows you to:
• Browse Cafe Bartique menu information and ordering options
• Access Toast’s ordering experience for food and beverage ordering, checkout, payment, and fulfillment
• Submit catering inquiries and receive follow-up from Cafe Bartique
• View upcoming events hosted at or associated with Cafe Bartique
• Browse Cafe Bartique’s Instagram photo gallery
• Create and manage your app account
2. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you must have the permission and supervision of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts of users who misrepresent their age.
3. Account Registration
Certain features of the App may require you to create an account. You may also use some features as a guest. Ordering, checkout, payment, and fulfillment may be handled through Toast’s ordering experience and may be subject to Toast’s own account, guest checkout, and ordering rules.
When registering, you agree to:
• Provide accurate, current, and complete information
• Maintain the accuracy of your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account at admin@cafebartique.com
• Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.
4. Account Deletion
You may delete your Cafe Bartique app account directly within the App by going to Profile → Settings → Account → Delete Account. You will be asked to confirm before deletion is completed.
If you cannot access the App, you may also contact us at admin@cafebartique.com with the subject line “Account Deletion Request” and include the name and email address associated with your account.
Deleting your Cafe Bartique app account removes your app account and associated app data, except information we are required or permitted to retain for legal, tax, fraud prevention, dispute resolution, business record-keeping, or completed transaction purposes. Deleting your Cafe Bartique app account does not automatically delete records held independently by third-party services such as Toast, Firebase, Expo, or Curator.io.
5. Acceptable Use
You agree to use the App only for lawful purposes. You may not:
• Use the App for fraudulent, deceptive, or unauthorized activity
• Submit false, misleading, or spam catering inquiries
• Attempt to gain unauthorized access to any system, data, or account
• Interfere with or disrupt the operation, security, or performance of the App or our servers
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• Scrape, crawl, or use automated tools to extract data from the App
• Impersonate another person or misrepresent your affiliation with any person or entity
Violations may result in immediate suspension or termination of your access without notice.
6. Menu and Ordering
The App displays our current menu. Ordering, checkout, payment, and fulfillment are handled through Toast POS, which operates its own ordering experience. You acknowledge that:
• Menu items, descriptions, and prices are subject to change without notice
• Item availability may vary; Cafe Bartique reserves the right to cancel or modify orders if an item is unavailable
• Orders are subject to Toast POS’s ordering terms and conditions
• All sales are final unless otherwise required by applicable law or addressed in our refund policy
7. Payments
Food and beverage ordering, checkout, payment, and fulfillment may be handled through Toast’s ordering experience. Toast’s own terms and privacy policy apply to those transactions.
For catering inquiries, payment is arranged directly between Cafe Bartique and the customer outside the App after an inquiry is confirmed (for example, by invoice, card payment in person, or another method agreed upon with our team). The App itself does not collect or store any payment card or banking information. Refunds, if applicable, are handled according to Cafe Bartique’s policies and the applicable payment method’s timing and rules.
8. Catering Inquiries
The App allows you to submit a catering inquiry form for events and group orders. You acknowledge that:
• Submitting a catering inquiry is not a confirmed booking or order; it is a request for a quote
• A member of the Cafe Bartique team will contact you to discuss availability, finalize menu selections, and provide customized pricing
• Catering is subject to 72-hour advance notice for platters and 48-hour notice for lunchbox group orders
• Final pricing is determined by Cafe Bartique after reviewing your inquiry and is not guaranteed until confirmed in writing
• You agree to provide accurate event information and notify us promptly of any changes
• Catering inquiries submitted through the App are received and reviewed by Cafe Bartique staff via email at admin@cafebartique.com
9. Events
The App displays upcoming events hosted at or associated with Cafe Bartique. Event details including dates, times, ticket information, and descriptions are provided for informational purposes. We reserve the right to cancel, reschedule, or modify events at any time. Cafe Bartique is not responsible for any costs or inconvenience arising from event changes.
10. Instagram Photo Gallery
The App includes a photo gallery displaying content from Cafe Bartique’s official public Instagram account, aggregated via Curator.io. This content is provided for informational and aesthetic purposes only. All photos remain the intellectual property of their respective owners. By viewing this content, you agree to use it solely within the App and not to reproduce, download, or redistribute it without permission.
11. Push Notifications
With your consent, we may send you push notifications about upcoming events, announcements, promotions, menu updates, and other app-related messages. You may opt out at any time through your device’s Settings or within the App (Settings → Push Notifications).
12. Intellectual Property
All content within the App — including but not limited to the Cafe Bartique name, logo, trademarks, menu content, text, graphics, photographs, and App design — is owned by or licensed to Cafe Bartique and protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, transmit, display, perform, or otherwise use any content from the App for commercial purposes without our prior written permission.
The App itself is licensed to you for personal, non-commercial use only. This license is non-transferable, non-exclusive, and revocable.
13. Third-Party Services
The App integrates with third-party services including Toast POS, Firebase, Expo, Curator.io, and Instagram. Your use of the App may be subject to the terms and conditions of these third-party providers. Cafe Bartique is not responsible for the availability, accuracy, content, or practices of any third-party services. Links or integrations with third-party services do not constitute our endorsement of those services.
14. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CAFE BARTIQUE DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAFE BARTIQUE AND ITS OWNERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
16. Indemnification
You agree to defend, indemnify, and hold harmless Cafe Bartique and its owners, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
17. Apple App Store and Google Play
If you download the App from the Apple App Store, Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App. In the event of a conflict between these Terms and Apple’s App Store Terms of Service, the App Store Terms shall govern solely with respect to Apple’s role. Apple has no warranty obligations for the App and is not responsible for any claims relating to the App.
If you download the App from Google Play, Google is not a party to these Terms and bears no responsibility for the App or its content.
18. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will update the date at the top of this page and notify you within the App where appropriate. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with updated Terms, you must stop using the App.
19. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the jurisdiction of those courts.
20. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cafe Bartique with respect to your use of the App and supersede all prior agreements and understandings, whether written or oral, relating to the App.
